Japan's top court sends back maternity harassment case-NHK
2014-10-24 Fri 06:36
Japan's Supreme Court has ruled that demotion on grounds of pregnancy or childbirth is unlawful and void in principle.

This was the first such ruling by the court.

The top court on Thursday overturned a lower court decision and ordered a retrial for a woman who had worked for a hospital in Hiroshima.

She had sued the hospital, arguing that it violated a law by removing her from a managerial position after learning that she was pregnant. She had reportedly asked that her workload be reduced.

The top court ruled that assigning a woman worker to a lower post due to pregnancy or childbirth is illegal unless the woman accepts it of her own free will or there are special circumstances of necessity.

The court said the plaintiff did not agree to her demotion. It then sent the case back for re-deliberation to the high court, which earlier dismissed the women's damages claim against the hospital.

Thursday's ruling will likely prompt employers to strictly deal with poor working conditions for pregnant women and those with young children, who often suffer maternity harassment in the workplace.
